Privacy Policy
Sunny Earth LLC ("Sunny Earth," "we," "us," or "our") respects your privacy. This Privacy Policy (the "Policy") describes how we collect, use, and disclose personal information, and the choices and rights you may have, when you visit our websites (including www.sunnyearth.us), use any customer portal or online tools we offer, communicate with us by phone, email, or text message, use our text-message program (the "SMS Service"), request a quote, or become a Sunny Earth customer (together, the "Services"). This Policy is incorporated into our Terms of Service. It does not apply to information we collect from job applicants or employees.
By using the Services, you agree to the terms of this Policy. We may modify this Policy at any time. The date of the last update is posted at the top of this Policy, and changes are effective immediately upon posting. If we make a material change that expands how we use personal information, we will make reasonable efforts to notify you. Your continued use of the Services after a change means you accept the updated Policy.
"Personal information" means information that identifies, relates to, or could reasonably be linked to you or your household, such as your name, address, mobile phone number, email address, or username, and any personal information you choose to include in messages you send us.
1. Information We Collect
The information we collect depends on how you interact with us. It may include:
Identifiers and contact details: name, mailing and installation address, email address, telephone and mobile numbers, account or portal login credentials, and, for lease applications and transfers, date of birth, Social Security number, and driver's license or other government identification.
Property and home information: home ownership status, roof type and condition, photographs and satellite or aerial imagery of your home, electrical panel and equipment details, homeowners' association information, and permit history.
Energy and utility information: your utility provider and account number, historical usage and billing data, interconnection and net-metering details, and, after installation, production, consumption, and system performance data from monitoring equipment.
Financial and commercial information: payment card or bank account details, lease and financing application information, consumer report and credit information obtained with your authorization, payment history, incentive and rebate eligibility information, and records of the products and services you request or receive.
Communications: the content of emails, chats, texts, and letters you exchange with us, recordings of calls with our team where permitted by law, customer service history, and comments, feedback, reviews, or survey responses.
SMS Service information: your mobile phone number when you opt in or send a message to us, the text of any messages you send, any username you select in connection with the SMS Service, your opt-in and opt-out history, and comments or feedback regarding the SMS Service.
Device and usage information: IP address, browser and device type, operating system, referring pages, pages viewed, time spent, links clicked, and similar information collected through cookies and similar technologies when you use our websites or portal.
Geolocation: general location inferred from your IP address or the address you provide; we do not collect precise device location without your permission.
Inferences: conclusions we draw from the above, such as whether your home is a good fit for solar or which offers may interest you.
2. How We Collect Information
Directly from you
When you request a quote, fill out a form, create an account, sign a Customer Agreement, apply for a lease or transfer, make a payment, upload documents or photos, participate in a promotion, complete a survey, or contact us by phone, email, chat, or text.
Automatically
When you use our websites or portal, we and our service providers use cookies, pixels, log files, and similar tools to collect device and usage information. We use necessary cookies to operate the site, analytics cookies to understand how it is used, and marketing cookies to measure our advertising and show you relevant offers. You can manage cookies through your browser settings; some features may not work if cookies are disabled. Our websites do not currently respond to "Do Not Track" signals.
From third parties
We may receive information about you from our installer and its subcontractors; lenders and finance companies you choose to work with; consumer reporting agencies; your utility; state and local incentive, permitting, and interconnection programs; mapping and property-data providers; referral partners and customers who refer you; marketing and lead-generation partners; and public records. We may combine this information with information we collect from you or automatically.
Through the SMS Service
The SMS Service is provided through a third-party messaging platform. When you use the SMS Service, we may collect the SMS Service information described in Section 1 through that provider. Messages sent through the SMS Service may be stored on our servers or those of our hosting and messaging providers.
3. How We Use Personal Information
We use personal information for the following purposes:
To provide the Services, including preparing quotes and system designs, evaluating your home, arranging installation, activating and monitoring your system, and honoring our warranties and guarantees.
To process lease applications and transfers, run authorized credit checks, process payments, and administer your account and any Customer Agreement.
To apply for permits, utility interconnection, net metering, and available incentives, rebates, and abatements on your behalf or for the system, and to claim benefits that belong to the system owner.
To provide you with the SMS Service and other communications you have requested.
To process and respond to inquiries, requests, and customer service issues.
To contact you with important announcements or messages about your account, your system, appointments, and service.
To market our products and services to you by mail, email, phone, and text, and to measure the effectiveness of our marketing, subject to your choices described in Section 7.
To improve the Services, develop new products and services, and conduct research and analytics.
To provide anonymous or aggregated reporting for internal and external purposes.
To detect and prevent fraud, protect the security of our systems, and enforce our Terms of Service and Customer Agreements, including for billing and collection.
To comply with legal, regulatory, tax, and contractual obligations, including obligations to the New York Public Service Commission and other government agencies.
For any other purpose described to you at the time of collection or with your consent.
4. How We Disclose Personal Information
Sunny Earth LLC does not sell or rent your personal information. We disclose personal information only in the following situations:
With your consent or at your direction.
Installers and subcontractors who design, install, inspect, and service your system, and who need your contact, property, and scheduling information to do so.
Service providers that process information on our behalf under confidentiality and security agreements, such as hosting, messaging, payment, credit reporting, monitoring, mapping, document signature, customer support, and analytics providers, and other third parties under non-disclosure agreements.
Lenders and finance companies you choose to work with, to the extent needed to arrange or service your financing.
Utilities, permitting authorities, and incentive programs in connection with interconnection, inspections, net metering, and incentive, rebate, or abatement applications.
Affiliated companies under common ownership or control, and assignees, financing parties, and investors in the systems we own, as permitted by your Customer Agreement.
Industry nonprofits such as solar advocacy organizations, only where your Customer Agreement or your separate consent permits.
To enforce our Terms of Service or a Customer Agreement, or to protect our rights, property, or safety or those of our customers or others.
In response to legal requests, such as subpoenas, court orders, or other legal process, or to comply with law or a government or regulatory request.
To protect against fraud or illegal activities.
In the event of a business transfer, such as a merger, acquisition, financing, reorganization, or sale of assets (including the sale or assignment of the systems we own), your information may be transferred to the new entity. We may share aggregated or de-identified data (for example, the total number of messages sent or the number of systems installed in a county) without further notice, and we will not attempt to re-identify de-identified data except as permitted by law.
Text-message opt-in data: your mobile phone number and your consent to receive text messages are collected only for the SMS Service. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Sharing with our messaging service provider is limited to what is necessary to deliver the SMS Service. All other categories of information described above exclude text-messaging originator opt-in data and consent.
5. Energy Usage and System Data
If you become a Sunny Earth customer, your Customer Agreement authorizes us to access your utility meter and energy usage data, to install production and consumption monitors, and to combine that data with your name and address so that we can monitor, maintain, and warrant your system. We use system data to calculate any production guarantee, to detect faults, and to plan and evaluate energy programs. We may share system and usage data with your utility, with monitoring and equipment manufacturers, with financing parties, and, where your Customer Agreement permits, with industry nonprofits. Please review the data provisions of your Customer Agreement for details.
6. SMS Service Privacy
This section applies specifically to the SMS Service and supplements the rest of this Policy.
Opting In
You may opt in to the SMS Service in several ways:
By entering your phone number online
By sending a Mobile Originating (MO) message with a specified keyword
By completing a paper form with your phone number
By signing up at a point-of-sale location
When you opt in, you will receive the confirmation message: "TEXT JOIN to (917) 423-6612 to sign up to receive notifications from Sunny Earth LLC." You will receive recurring messages; message frequency varies. Message and data rates may apply.
Opting Out
You can opt out of the SMS Service at any time by texting "STOP" or "QUIT" to (917) 423-6612 or to the number that texted you. We will send one final message confirming that you have been unsubscribed. You may still receive essential non-marketing communications related to your account or system, such as administrative or safety messages. Text "HELP" for assistance.
Consent
By opting in to the SMS Service and providing your mobile phone number, you authorize Sunny Earth LLC to contact you by text message using an automatic telephone dialing system or device, or any other computer-assisted technology as applicable. You are not required to consent to the SMS Service to receive any other services from Sunny Earth LLC, and consent is not a condition of any purchase.
Messages Are Not Private
Information you share with other users, or that others can see on your device, is not covered by this Policy. Anyone with access to your mobile phone may be able to view messages you receive. Please avoid transmitting sensitive personal or identifying information, such as Social Security or account numbers, by text message.
7. Your Choices
Marketing communications
Email: use the unsubscribe link in any marketing email or email us at mary@sunnyearth.us.
Telephone: to be placed on our internal Do Not Call list, email mary@sunnyearth.us with "Do Not Call" in the subject line, call (929) 223-6584, or ask the representative who calls you. We will honor your request as soon as reasonably practicable. A new inquiry or quote request from you may result in further contact.
Text messages: text "STOP" to (917) 423-6612 as described in Section 6.
Direct mail: email or write to us at the address in Section 12.
Opting out of marketing does not stop transactional or service communications about your account, appointments, or system, and does not opt you out of communications from unaffiliated third parties, from whom you must opt out separately.
Cookies and targeted advertising
You can limit cookies through your browser settings and can opt out of participating advertising networks through the Digital Advertising Alliance at www.aboutads.info/choices or the Network Advertising Initiative at optout.networkadvertising.org. These opt-outs are browser- and device-specific.
Accessing and updating your information
Customers may request corrections to account information by contacting us at (929) 223-6584 or mary@sunnyearth.us. We may decline a change that we believe would be inaccurate or would violate a legal requirement.
8. Security and Retention
Sunny Earth LLC takes reasonable administrative, technical, and physical precautions to protect your personal information from loss and from unauthorized access, use, alteration, and disclosure, consistent with the New York SHIELD Act. However, no method of transmission or storage is 100% secure. While we strive to protect your data, we cannot guarantee absolute security.
We keep personal information for as long as reasonably necessary for the purposes described in this Policy, which for customers generally means for the term of your Customer Agreement plus the period required by tax, accounting, warranty, and legal obligations and applicable limitation periods. We keep records of SMS opt-ins and opt-outs for as long as required to demonstrate compliance. When information is no longer needed, we delete or de-identify it, or securely isolate it until deletion is possible.
9. Children
The Services, including the SMS Service, are intended for adults and are not directed to individuals under 18. Sunny Earth LLC does not knowingly collect personal information from anyone under 18. If you believe a minor has provided us with personal information, please contact us at mary@sunnyearth.us and we will take reasonable steps to delete it.
10. Intended Audience
The Services are intended for residents of the United States only, and we currently serve customers in New York. If you access the Services from outside the United States, you do so at your own risk and consent to the processing of your information in the United States.
11. Additional State Privacy Rights
Depending on where you live, you may have rights under state privacy law to: request access to the personal information we hold about you and the categories of sources, purposes, and recipients; receive a portable copy; correct inaccurate information; delete information, subject to exceptions such as completing a transaction, honoring a Customer Agreement, or complying with law; and opt out of the sale of personal information, targeted advertising, or certain profiling. We do not sell personal information. To exercise a right, email mary@sunnyearth.us or call (929) 223-6584. We will verify your identity by matching the information you provide to our records and will respond within the time required by applicable law. You may appeal a denial by replying to our response, and you may use an authorized agent if the agent provides proof of authority. We will not discriminate against you for exercising your rights.
